Mr. Mercer's Despatch No 107 of 21st May 1863, when the Judge's notes were enclosed, was asked to send him and permission home in accordance with the course pursued in the Case of Abac Codd (see Your Grace's Despatch No 106 of 26th November 1860)
In consequence of Your Grace's reply (No 134 of 19th October 1863) Thompson was sent home as I have stated, (See My Mercer's Despatch No 4 of 12th January last)

His case is briefly this: He was in command of "bentaur", and had a difference with the mate, one Mr. Scott's Subordinate, No 2, N. 3, Wiggans, who had expressed a determination to oust him from his command.
The allegation is that Wiggans drugged Thompson's Coffee, and under the influence of that drug, Thompson, not being in possession of his senses, snapped a pistol at certain persons. He was on board, and for this he was charged with the crime of attempting to shoot and murder.

Of this charge he was acquitted on the ground of insanity as shown in the notes of the Acting Chief Justice already before Your Grace, but it will be seen from a Memorial shortly after presented to Mr Mercer, through Mr Scott, that the Jury were altogether unaware of the consequences attendant upon the rendering
